By preventing the College Board from sharing scores with U.S. News & World Report, the state effectively shielded traditional public schools from direct comparison. The move caused Success Academy, a high‑performing charter network, to plunge from 11th to 196th in the rankings despite its students’ exceptional AP pass rates. This kind of suppression looks less like a privacy concern and more like an attempt to avoid accountability.
What’s happening in New York is not an isolated bureaucratic quirk — it’s a blueprint. When a state can simply withhold independently verified academic results, it creates a precedent that any education department could use to protect underperforming systems. Teachers unions and entrenched district interests already resist transparent metrics, and New York’s justification — that reporting AP scores is “commercialization” — could easily be adopted elsewhere.
